3. Our Role: Service Provider vs. Data Controller
It is important to understand our role in handling data:
- RoshanAI360 is the Service Provider (Processor): We provide the infrastructure, AI technology, and telephony systems to handle calls. We process data strictly according to our Client’s instructions.
- The Client is the Data Controller: The business using our service (e.g., the plumbing or electrical company) controls why data is collected and how it is used.
Important Note on Liability:
Our Clients are responsible for ensuring their use of RoshanAI360 complies with all applicable laws, including obtaining necessary consents for call recording and adhering to the Telecommunications (Interception and Access) Act 1979. RoshanAI360 is not liable for a Client’s failure to notify callers of recording or AI usage.

We do not sell your personal information to third parties.
7. AI Voice Calls, Recording & Consent
RoshanAI360 operates AI voice agents that simulate human conversation.
- Notification: We strongly recommend and provide the capability for our Clients to play a disclosure message at the start of every call (e.g., “This call is answered by AI and may be recorded”).
- Implied Consent: By remaining on the line after the disclosure, the Caller consents to the recording and processing of their voice data by our AI systems.
- Transcription: Calls are transcribed in real-time to allow the AI to understand and respond.
8. Third-Party AI Sub-Processors
To provide our intelligent voice services, we utilize third-party Artificial Intelligence and Telephony providers (e.g., Large Language Models (LLMs) and Voice Synthesis engines).
- Data passed to these providers is encrypted.
- We utilize enterprise-grade agreements where possible to ensure your data is not used to train public AI models.
- Data is used strictly to generate the response for that specific interaction.
9. Data Storage, Security & Overseas Transfer
We take reasonable steps to protect personal information from loss, misuse, and unauthorized access.
- Storage: Data is stored on secure cloud infrastructure with encryption protocols (SSL/TLS).
- Overseas Processing: While we are an Australian business, the nature of cloud computing and AI means some data processing (specifically by our AI sub-processors) may occur on servers located outside Australia (typically in the United States).
- By using our service, you acknowledge and consent to this cross-border transfer solely for the purpose of processing the call.
10. Data Retention & Deletion
- Retention: We retain data only as long as necessary to provide the service or comply with legal obligations (e.g., tax laws).
- Deletion: Clients may request the deletion of call logs and recordings associated with their account. Upon termination of service, data is deleted or anonymized in accordance with our Terms of Service.
11. Data Breaches
In the unlikely event of a data breach that is likely to result in serious harm, we will:
- Promptly investigate and contain the breach.
- Notify affected individuals and Clients.
- Report to the Office of the Australian Information Commissioner (OAIC) as required by the NDB scheme.
